Terms and Conditions

These General Terms and Conditions (hereinafter: T&C) set out the conditions for using the services available on the artivistaoptics.com website (hereinafter: Website). By using the Website, the User acknowledges and accepts the provisions of these T&C.

2. Activity on the Website
Online retail sale of optical products (eyewear, sunglasses, and accessories).
3. Terms of Use
3.1. Liability
The User uses the Website at their own risk and accepts that the Service Provider shall not be liable for any material or non-material damages arising from such use, beyond liability for damages caused intentionally, through gross negligence, or by criminal act, as well as damages to life, physical integrity, or health resulting from breach of contract. The Service Provider excludes all liability for the conduct of Website users and the User is fully and exclusively responsible for their own conduct. The User is obliged to ensure that their use of the Website does not infringe upon the rights of third parties or any laws, either directly or indirectly.
3.2. Copyright
The entirety of the Website (texts, images, graphic elements, etc.) is subject to copyright protection. Copying, modifying, or distributing for commercial purposes is prohibited.
4. Purchasing on the Website
4.1. Order Process
The Website provides product presentation and online ordering functionality for Users. Users can browse through menu items and product categories. The selected product can be placed in the cart using the cart button. Users can review the contents of their cart via the Cart menu. Users may proceed with the purchase by clicking the Order button.
During registration, Users must provide the following information: email address, name, phone number, billing address, and shipping address if different. The next step requires the User to select their preferred payment and shipping method.
4.2. Binding Offer, Confirmation
The Service Provider shall inform the User of the confirmation within 48 hours. If the User does not receive the confirmation within 48 hours, they are released from their binding offer.
4.3. Formation of Contract
The contract may be concluded in Hungarian. Placing an order constitutes an electronically concluded contract governed by Act CVIII of 2001 on certain aspects of electronic commerce services and information society services. The contract falls under Government Decree 45/2014 (II.26.) on detailed rules of contracts between consumers and businesses.
4.4. Archiving of Contract
A contract concluded through the Website does not constitute a written contract; the Service Provider does not archive it, and it is not accessible retrospectively.
4.5. Invoice
The Service Provider issues a paper-based invoice, which is sent together with the goods.
4.6. Payment Methods
Online card payment (SimplePay), Cash on delivery, Cash at pickup, PayPal.
4.7. Shipping
Delivery of online orders takes place within the expected delivery time indicated on the product page; for in-stock items, within 1–5 business days.
5. Right of Withdrawal
In accordance with Government Decree 45/2014 (II.26.) on detailed rules of contracts between consumers and businesses, the consumer may withdraw from the contract without giving any reason within 14 days from the date of receipt of the goods. The consumer may also exercise the right of withdrawal during the period between the conclusion of the contract and the receipt of the product.
If the consumer wishes to exercise the right of withdrawal, they must send a clear statement to info@artivistaoptics.com. In case of withdrawal, the consumer must return the product without undue delay, but no later than 14 days from the communication of the withdrawal statement. The cost of return is borne by the consumer. The Service Provider shall refund all consideration paid by the consumer, including delivery costs, without undue delay and no later than 14 days after the return of the product.
6. Warranty and Guarantee
In case of defective performance by the Service Provider, the User may assert a warranty claim in accordance with the provisions of the Civil Code. The consumer may switch from the chosen warranty right to another, but shall bear the cost of the switch unless it was justified or the Service Provider gave cause for it.
For certain products, the manufacturer may offer a guarantee. The conditions of the guarantee are contained in the guarantee certificate enclosed with the product.
7. Complaint Handling
The consumer may submit complaints regarding the product or the Service Provider's activities at:

The Service Provider shall examine verbal complaints immediately and remedy them if possible. Written complaints shall be answered in writing within 30 days. In case of rejection, the consumer may turn to the conciliation body with jurisdiction over their place of residence, or to the court.

8. Other Provisions
The Service Provider reserves the right to modify these T&C at any time. New terms take effect upon publication on the Website.
Purchasing on the Website presupposes the User's knowledge and acceptance of the possibilities and limitations of the Internet, with particular regard to technical performance and potential errors. The Service Provider shall not be liable for any operational error in the internet network that prevents the operation of the Website or purchasing.
